Local Authorities have a duty to assess the needs of people who may need services themselves, such as the elderly or those with a physical or mental disability. The Local Authority may have to provide services to that person, such as home help or occupational therapy, or accommodation (which could be residential or a nursing home).

The rules relating to the provision and payment of services and accommodation are complex.

We can help you if you or a family member are not getting the services or accommodation which you need or if you feel that you are being asked to pay to much. We can provide advice and representation on the following matters:

  • Local Authority’s failure to carry out an assessment and/or to provide adequate care needs
  • Withdrawal and reduction of community care services
  • Changes to community care services or accommodation
  • Cost of services
  • Provision of after care services for those with mental health problems
  • Making decisions for patients lacking mental capacity

In 2006 we represented a client in a leading case in which she successfully challenged a decision by Bexley NHS Trust that she was not entitled to full NHS funding- Grogan v Bexley NHS Trust [2006] EWHC 44 (Admin).

Many of our clients are eligible for free legal advice. We will always advise you as to your eligibility for legal aid and we will help you with your application. If in your particular circumstances legal aid is not available, we offer competitive rates should you wish to instruct us privately and we are happy to discuss the cost of representation in your case.

We aim to deal with cases in a constructive and non-confrontational manner, with referrals to mediation in the first instance where appropriate, so as to avoid the costs. . If however court proceedings do become necessary, we will work hard to bring your case to a fair conclusion. We have expertise in advising on the legal procedure of divorce, the dissolution of civil partnerships and judicial separation. We can advise on resolving financial matters including the legal ownership of property and financial settlements for children. In certain circumstances we can obtain emergency financial injunctions.​
